Excuse me, can you tell me the make and model of the gun you are holding me up with?
You can only defend yourself with the same weapon that the robber is using to rob you.
Related Stupid Laws, Crazy Laws, and just plain Stupid Laws:
- No glue sniffing!
- Oral sex = illegal
- Model planes can only be flown at your house or next to the morgue
- I guess the Airforce and NASA are outlaws in California
- Look Ma! No Hands = illegal

So, basically the law says you got to keep a huge arsenal of weapons with you at all the times if you want to defend yourself? Lol
(Better be robbing people with real exotic weapons then.)

well all i have to say is it is true cause i got robbed at gun point and i stabbed the guy and i was arrested for assualt when he had the gun pointed at me the judge told me that if i had shot the guy it would have been self defense so i asked ok if i shot him with a hand gun i would be walking out of here judge says yep
Now tell me how stupid is that i have to have a gun and a knife on me at all times just to protect my self fuck that i am going to defend my self how ever i can if it means that i beat them with my fists then so be it i worked hard for my stuff and i am going to keep it

I’m curious on this one, I’ve seen it listed on these “dumb laws” sites, but noone references the ARS code that that describes the full extent of this law. I know for a fact that this is not the case in defending your property – you just cant shoot them in the back.

Unfortunately this idiotic law is all too real. It was enacted some fifty years ago. In practice I agree with the first comment; I’ll shoot the bastard and sort it out later.

The law this is quoting from is one that is commonly called Equal Force Protection. Long story shot, if some one tries to cut you with a knife and you shoot that person, you used GREATER FORCE, and that is where you get in trouble. HOWEVER, if you use lesser force to stop some one, you are in the clear…I feel bad for you Jade Kitty, because you got conned…if the person was robbing you at gun point in AZ, and you stabbed the person, then you were in the right because the robber was using a greater degree of force than you were, so he “should” have been able to succeed in the robbery. HOWEVER, there are other circumstances, such as where the robbery took place (on the street or at your home, for example) and the other element of the crime was if you felt like you were in danger for your life….personally, if some one has a gun pointed at me, I am mortally afraid for my life and well within my legal rights to act in self preservation, doing what ever is necessary to survive…that is the legal element of this….long story short Jade Kitty, you got screwed by the judge who didn’t really know the law after all…
