<blockquote><p><strong class="HeadlineText">City Withdraws Ordinance</strong></p>
<p>Ordinance No. 06, 2007, which amended Section 75-41 and 75-42 of Lafayetteâ€™s Municipal Code regarding the maximum penalties for possession of cannabis (marijuana), has been withdrawn.  City staff and City Council have determined that more information and analysis are needed on this matter, and it will be the subject of a Council Workshop Meeting on April 3.  If and when the ordinance is brought forward after the workshop City Councilâ€™s process for voting on the ordinance will start from the beginning, with votes required at two separate Council Meetings.</p>
<p>The April 3 City Council Workshop will be held at City Hall, Council Chambers, 1290 South Public Road, at 5:30 PM.   The workshop meeting is open to the public and will be broadcast live on Cable Channel 8.</p></blockquote>

<blockquote><p>Sec. 8-136. Telephone communications, improper language, harassment.</p>
<p>Â </p>
<p>(a) No person shall:</p>
<p>(1) Engage in or institute a telephone call, telephone conversation, or telephone conference, with another person, anonymously or otherwise, and therein use obscene, profane, vulgar, lewd, lascivious, or indecent language, or make any suggestion or proposal of an obscene nature or threaten any illegal or immoral act with the intent to coerce, intimidate, or harass another person;</p>
<p>(2) Make repeated telephone communications anonymously or otherwise in a manner reasonably expected to annoy, abuse, torment, harass, embarrass, or offend another, whether or not conversation ensues;</p>
<p>(3) Make a telephone call and intentionally fail to hang up or disengage the connection;</p>
<p>(4) Engage in a telephone call, conference, or recorded communication by using obscene language, when by making a graphic description of a sexual act, and the offender knows or reasonably should know that such obscene or graphic language is directed to, or will be heard by, a minor. Lack of knowledge of age shall not constitute a defense;</p>
<p>(5) Knowingly permit any telephone under his control to be used for any purpose prohibited by this section.</p>
<p>(b) Any act described above shall be unlawful and shall constitute an offense, and any such offense committed by use of a telephone as set forth in this section shall be deemed to have been committed at either the place where the telephone call or calls originated or at the place where the telephone call or calls were received.</p>

<p>Amusements places are defined, for the purposes of this article, as any business, place or establishment where three (3) or more coin-operated amusements games such as, but not limited to, flipper type machines, target machines, foosball machines and the like are available for the use and enjoyment of the public and the operation of which constitutes the primary or principal business of any such place, business or establishment.</p>

<p>Â </p>
<p>Ritualistic acts</p>
<p>A.(1) The legislature hereby finds that this enactment is necessary for the immediate preservation of the public peace, health, morals, safety, and welfare and for the support of state government and its existing public institutions.</p>
<p>(2) The legislature further recognizes that:</p>
<p>(a) The preamble to the Constitution of Louisiana affirmatively states &#8220;We, the people of Louisiana, grateful to Almighty God for the civil, political, economic, and religious liberties we enjoy, and desiring to protect individual rights to life, liberty, and property; afford opportunity for the fullest development of the individual; assure equality of rights; promote the health, safety, education, and welfare of the people; maintain a representative and orderly government; ensure domestic tranquility; provide for the common defense; and secure the blessings of freedom and justice to ourselves and our posterity, do ordain and establish this constitution.&#8221;</p>
<p>(b) The state, under its police power, may enact laws in order to promote public peace, health, morals, and safety.</p>
<p>B.(1) For purposes of this Subsection, &#8220;ritualistic acts&#8221; means those acts undertaken as part of a ceremony, rite, initiation, observance, performance, or practice that result in or are intended to result in:</p>
<p>(a) The mutilation, dismemberment, torture, abuse, or sacrifice of animals.</p>
<p>(b) The ingestion of human or animal blood or human or animal waste.</p>
<p>(2) The acts defined in this Subsection are hereby determined to be destructive of the peace, health, morals, and safety of the citizens of this state and are hereby prohibited.</p>
<p>(3) Any person committing, attempting to commit, or conspiring with another to commit a ritualistic act may be sentenced to imprisonment for not more than five years or fined not more than five thousand dollars, or both.</p>
<p>C.(1) No person shall commit ritualistic mutilation, dismemberment, or torture of a human as part of a ceremony, rite, initiation, observance, performance, or practice.</p>
<p>(2) No person shall commit ritualistic sexual abuse of children or of physically or mentally disabled adults as part of a ceremony, rite, initiation, observance, performance, or practice.</p>
<p>(3) No person shall commit ritualistic psychological abuse of children or of physically or mentally disabled adults as part of a ceremony, rite, initiation, observance, performance, or practice.</p>
<p>(4) Any person who commits, attempts to commit, or conspires with another to commit a violation of this Subsection shall be sentenced to imprisonment for not less than five nor more than twenty-five years and may be fined not more than twenty-five thousand dollars.</p>
<p>D. Each violation that occurs under the provisions of this Section shall be considered a separate violation.</p>
<p>E. The provisions of this Section shall not be construed to apply to generally accepted agricultural or horticultural practices and specifically the branding or identification of livestock.</p>

<p>Unauthorized use of a movable</p>
<p>A. Unauthorized use of a movable is the intentional taking or use of a movable which belongs to another, either without the other&#8217;s consent, or by means of fraudulent conduct, practices, or representations, but without any intention to deprive the other of the movable permanently. The fact that the movable so taken or used may be classified as an immovable, according to the law pertaining to civil matters, is immaterial.</p>
<p>B. Whoever commits the crime of unauthorized use of a movable having a value of one thousand dollars or less shall be fined not more than five hundred dollars, or imprisoned for not more than six months, or both. Whoever commits the crime of unauthorized use of a movable having a value in excess of one thousand dollars shall be fined not more than five thousand dollars, or imprisoned with or without hard labor for not more than five years, or both.</p>

<p>Â </p>
<p>A. Theft of an alligator is the misappropriation or taking of an alligator, an alligator&#8217;s skin, or a part of an alligator, whether dead or alive, belonging to another, either without the consent of the other to the misappropriation or taking, or by means of fraudulent conduct, practices, or representations. An intent to deprive the other permanently of the alligator, the alligator&#8217;s skin, or a part of an alligator is essential.</p>
<p>B.(1) Whoever commits the crime of theft of an alligator when the misappropration or taking amounts to a value of five hundred dollars or more shall be imprisoned, with or without hard labor, for not more than ten years, or may be fined not more than three thousand dollars, or both.</p>
<p>(2) When the misappropriation or taking amounts to a value of one hundred dollars or more, but less than a value of five hundred dollars, the offender shall be imprisoned, with or without hard labor, for not more than two years, or may be fined not more than two thousand dollars, or both.</p>
<p>(3) When the misappropriation or taking amounts to less than a value of one hundred dollars, the offender shall be imprisoned for not more than six months, or may be fined not more than five hundred dollars, or both. If the offender in such cases has been convicted of theft of an alligator two or more times previously, upon any subsequent conviction he shall be imprisoned, with or without hard labor, for not more than two years, or may be fined not more than one thousand dollars, or both.</p>
