30-5. Removal of excrement.The owner shall carry and use a bag or other device to pick up and remove any excrement said dog shall drop on property other than their own.

� 30-6. Penalties for offenses.

Any person violating the provisions of this Article shall be subject to a penalty of not less than twenty-five dollars ($25.), nor more than one hundred dollars ($100.), plus court costs. Each day of continued violation shall be considered as a separate offense.

134-13. Alcoholic beverages prohibited.

No person shall sell, give, dispense, provide or keep or cause to be sold, given, dispensed, provided or kept any alcoholic beverage on the premises of any dance hall establishment.

198-13. Topless bathing suits prohibited.

No female over the age of five years shall wear a topless bathing suit or otherwise fail to cover her breasts with less than a full opaque covering of any portion thereof below the upper portion of the nipple.

198-15.

Changing clothes in comfort station prohibited. No person shall change his clothing from bathing suit to street clothes or otherwise within the comfort stations maintained by the city.

198-30. Sleeping on boardwalk.

No person shall sleep, lie or occupy as a sleeping quarter, or under the guise of pretending to sleep on the boardwalk, any bench located on the boardwalk in any pavilion located at the end of any street or on any bench located on any street.

198-23. Disturbing religious worship and lawful assemblies.

A.No person shall disrupt or disturb any congregation or assembly met for religious worship by noise, talking or whispering, or by rude or indecent behavior, or by profane language within their place of worship, or within 300 feet of the place of worship.

B.No person shall disturb any lawful assembly or gathering of people in any public place.

198-33. Halloween regulations; exceptions. [Amended 10-14-1977 by Ord. No. 1077-2; 10-11-1991 by Ord. No. 1091-1]

A.No person shall permit his child or any child under his control to go about the streets, ways and/or sidewalks within the corporate limits of the City of Rehoboth Beach for the purpose of causing mischief of any sort; provided, however, that children who have not attained the age of 14 years may go upon the streets, ways and/or sidewalks from door to door or house to house for treats between the hours of 6:00 p.m., prevailing time, and 8:00 p.m., prevailing time, on October 31 of any year; provided, however, that if October 31 shall be a Sunday, such going from door to door and house to house for treats shall take place on the evening of October 30 between the hours of 6:00 p.m., prevailing time, and 8:00 p.m., prevailing time.

B.Nothing in this section shall be deemed to prohibit the gathering and participation of children in a Halloween parade or costume contest sponsored by the Rehoboth Beach Chamber of Commerce or the service clubs of the city

198-14. Disrobing in public.

No person shall disrobe under the boardwalk, on the beach or in any vehicle or truck while such vehicle is parked upon any public street or way or other public place in plain view of the public.

116-5. Tailgating. [Amended 8-30-1980]

It shall be unlawful for any person to tailgate from any vehicle or picnic on any street or highway within the corporate limits of the Town of Fenwick Island, Delaware. For the purposes of this chapter, “tailgating” shall mean standing or sitting and eating or drinking on any street or highway and using the vehicle as a picnic facility.

116-4. Activities inside vehicles prohibited.

It shall be unlawful for any person to live, dwell, cook, sleep, change clothes or use toilet facilities inside any vehicle within the corporate limits of the Town of Fenwick Island, Delaware.

116-3. Sleeping on public beaches.

It shall be unlawful for any person to sleep, lie or loiter on, or occupy as a sleeping quarter or under the guise of pretending to sleep, on any part of the public beaches within the corporate limits of the Town of Fenwick Island, Delaware, between 12:00 midnight and 8:00 a.m. local time.

� 1366. Outdoor motion picture theatres.

(a) Whoever being the owner or operator of an outdoor motion picture theatre exhibits or permits to be exhibited any film not suitable for minors or harmful to minors and which film can be viewed by such minors not in attendance at the said outdoor motion picture theatre shall be guilty of a class A misdemeanor.

(b) Definitions as used in this section:

(1) “Code and Rating Administration of the Motion Picture Association of America” ratings are:

“G” – All ages admitted. General audiences;

“PG” – All ages admitted. Parental guidance suggested;

“R” – Restricted. Under 17 requires accompanying parent or adult guardian;

“X” – No one under 17 admitted.

(2) “Film” means any motion picture film or series of films, whether full length or short subject, but does not include newsreels portraying actual current events or pictorial news of the day.

(3) “Harmful to minors” means that quality of any description or representation, in whatever form, of nudity, sexual conduct, sexual excitement or sado-masochistic abuse which predominately appeals to the prurient, shameful or morbid interest of minors and is patently offensive to prevailing standards in the adult community as a whole with respect to what is suitable material for minors, and taken as a whole the work lacks serious literary, artistical, political or scientific value for minors.

(4) “Minor” means any person under the age of 17 years.

(5) “Not suitable for minors” means any film, reel or view which has a rating of “R” or “X” according to the Code and Rating Administration of the Motion Picture Association of America.

(6) “Nudity” means the showing of the human male or female genitals, pubic area or buttocks with less than a fully opaque covering, or the showing of the female breast with less than a fully opaque covering of any portion thereof below the top of the nipple or the depiction of covered male genitals in a discernibly turgid state.

(7) “Sado-masochistic abuse” means flagellation or torture practiced by or upon a person clad in undergarments, a mask or bizarre costume, or the condition of being fettered, bound or otherwise physically restrained on the part of one so clothed.

(8) “Sexual conduct” means acts of masturbation, homosexuality, sexual intercourse or physical contact with a person’s unclothed genitals or pubic area or a female person’s breast.

(9) “Sexual excitement” means the condition of human male or female genitals in a state of sexual stimulation or arousal.

(10) “Suitable for minors” means any film, reel or view which has a rating of “G” or “PG” according to the Code and Rating Administration of the Motion Picture Association of America.
